Regulations published July 30th by the Centers for Medicare & Medicaid Services (CMS) clarify when non-diagnostic services provided on an outpatient basis will be treated as inpatient services under the “3-Day Rule” in light of the clarifications made by the Preservation of Access to Care for Medicare Beneficiaries and Pension Relief Act of 2010 (“Preservation of Access to Care Act”). The regulations also finalize Medicare payment rates for inpatient services furnished to people with Medicare by acute care hospitals, long-term care hospitals (LTCHs), and certain excluded hospitals.
