DOJ Sets Minimum Standards For State & Local Government Website, Mobile App Disability Accessibility

Government hospitals and other health care providers, academic medicine and other schools, and other state and local governments should begin assessing their responsibilities under a new Justice Department final rule that requires State and local governments to improve web and mobile application (app) access for people with disabilities.

The rule clarifies what State and local governments must do to meet their existing duty under Title II of the Americans with Disabilities Act (ADA) for website or other activities movedto the digital space.

The rule, signed by the Attorney General earlier this month and published in the Federal Register today, adopts a technical standard for web and mobile accessibility to ensure that people with disabilities can better access important public services like health care, voting, and education. Read this fact sheet for a high level summary.

Today’s publication requires State and local governments with a population of 50,000 or more to comply with the rule’s requirements beginning on April 24, 2026. The compliance deadline for State and local governments with a population of less than 50,000, as well as special district governments, is April 26, 2027. This means that State and local governments’ web content and mobile apps will have to generally meet the technical standard in the rule by these dates and on an ongoing basis after these dates.

Until then, State and local governments still have existing ADA Title II, Section 1557 and other disability accessibility and accommodations aggressively enforced by government agencies like the Civil Rights Divisions of DOJ, the Department of Health & Human Services and Department of Education as well as private litigants. This means that even before the compliance dates, State and local governments must provide people with disabilities equal access to their services, programs, and activities offered via the web and mobile apps.

The Department plans to issue a Small Entity Compliance Guide to assist small State and local governments in complying with the rule. Stay tuned!

Meanwhile impacted health, education and other government entities and their contractors should begin evaluating and implementing the changes required to ensure the defensibility of the accessibility of their current web, mobile access and other services now and when the new rules take effect.

As websites, mobile apps and other Internet, based communications, records, and other services portals usually collect patient healthcare, financial, or other sensitive personal information and interface with medical, education, financial and other systems, these efforts should continuously include documented efforts to assess and fulfill data security, privacy, retention and other requirements under applicable laws like the Health Insurance Portability & Accountability Act, the Family Educational Rights Act, the Fair & Accurate Credit Tranactions Act and other relevant Federal and state privacy, data security and other laws.

Doctor’s Conviction Illustrates Advisability For Physicians To Know & Follow Federal Health Care Fraud Rules

Resources Summarize Key Health Care Fraud Rules

Physician health care fraud prosecutions and convictions of physicians like Arizona physician Linh Cao Nguyen, M.D. drive home the need for all physicians to ensure their understanding and ability to defend their compliance with federal and state healthcare fraud laws. This includes, but it’s not limited to proper coding and billing for the use of mid-level in the delivery of care. Physicians and other prescribers should review a recently released resource to get a basic overview of these federal healthcare fraud rules.

Nguyen Health Care Fraud Plea For Billing Delegated Care As Physician Provided

One of literally thousands of physicians and other prescribers prosecuted by federal prosecutors for health care fraud, Nguyen pleaded guilty on March 19, 2024, to Health Care Fraud. Nguyen’s sentencing is scheduled for May 28, 2024, before United States District Judge John C. Hinderaker.

Nguyen admitted that for years, he engaged in a scheme to defraud various health care benefit programs, including Medicare, TRICARE, AHCCCS, Blue Cross Blue Shield, and UnitedHealthcare.

Court documents charged the fraudulent claims generally identified a medical doctor as the treating provider when, in fact, another provider such as a nurse practitioner, social worker, unlicensed psychology intern, or wound care nurse provided the service independently. By billing the medical service as if it were provided by a physician, Nguyen falsely inflated the amount his company was to be paid for the service.

Through these prohibited practices, Nguyen confessed to knowingly causing submission of thousands of false billing claims.Nguyen falsely created patient records to conceal and avoid detection of his fraudulent billing scheme.

Nguyen admitted the loss he caused was at least $3.7 million dollars. He agreed to pay restitution to the private insurance companies totaling over $1 million.

A conviction for Health Care Fraud carries a maximum penalty of 10 years in prison and a $250,000 fine.

Along with ensuring that billing for care properly reflects the identity and legal capacity of the caregiver, physicians also have to negotiate a number of other federal healthcare laws.

The presentation summarizes the five main Federal fraud and abuse laws (the False Claims Act, the Anti-Kickback Statute, the Stark Law, the Exclusion Statute, and the Civil Monetary Penalties Law) and provide tips on how physicians should comply with these laws in their relationships with payers (e.g., the Medicare and Medicaid programs), vendors (e.g., drug, biologic, and medical device companies), and fellow providers (e.g., hospitals, nursing homes, and physician colleagues).

Physicians and another prescribers are encouraged to use these resources to help build their awareness of these rules as they relate to their practices. If any questions exist, physicians are encouraged to seek the advice of legal counsel to confirm their compliance.

April Is National Minority Health Month

April is National Minority Health Month, a time to emphasize the importance of improving health care in racial and ethnic minority communities. 

Health disparities undermine the health of impacted communities, drive up government, employer, insurer and community health and disability costs, and create needless suffering. 

While different organizations and studies use different definitions, health and health care disparities generally refer to differences in health and health care between groups that stem from broader inequities.

The Centers for Disease Control and Prevention (CDC) defines health disparities as “preventable differences in the burden, disease, injury, violence, or in opportunities to achieve optimal health experienced by socially disadvantaged racial, ethnic, and other population groups and communities.”

Healthy People 2030 defines a health disparity, as “a particular type of health difference that is linked with social, economic, and/or environmental disadvantage,” and that adversely affects groups of people who have systematically experienced greater obstacles to health.

The Kaiser Family Foundation reports that although health care is essential to health, research shows that health outcomes are driven by multiple factors, including underlying genetics, health behaviors, social and environmental factors, and access to health care.

While there is currently no consensus in the research on the magnitude of the relative contributions of each of these factors to health, studies suggest that health behaviors and social and economic factors, often referred to as social determinants of health, are the primary drivers of health outcomes and that social and economic factors shape individuals’ health behaviors. Moreover, racism negatively affects mental and physical health both directly and by creating inequities across the social determinants of health.

Helping to reduce health disparities begins with increasing awareness about health disparities that disproportionately impact people from historically marginalized communities, and by sharing resources to help.

Minority and underserved communities often face greater health care challenges including limited access to care, higher rates of chronic conditions, and worse health outcomes, as well as stigma and discrimination in health care settings. For example:

  • Black people are 30 percent more likely to die from heart disease, 50 percent more likely to have a stroke, and 30 percent more likely to have asthma.
  • Compared to non-Hispanic White persons, Hispanic individuals are 70 percent more likely to be diagnosed with diabetes by a physician and 1.2 times more likely to be obese.

Sometimes disparities are not from disease or actual care but arise from differences between groups in health insurance coverage, affordability, access to and use of care, and quality of care.
